1. Agreement to these Terms

These Terms govern your use of the TutorDay mobile application (the “App”), published by HORIS INTERNATIONAL LIMITED under the developer name Alps project. By installing or using the App, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the App.

The App is intended for people aged 18 or older. You confirm that you are legally able to enter into this agreement under applicable law.

2. Purpose and licence

TutorDay helps independent tutors, trainers, and instructors schedule lessons, maintain work information about students and groups, receive reminders, and transfer data.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on compatible devices. The App is licensed, not sold. We and our licensors retain all rights not expressly granted.

3. Your information and responsibilities

You are responsible for information you enter, import, export, or transfer through the App. In particular, you agree to:

• use TutorDay lawfully and only for permitted purposes;
• have a lawful basis for handling student information, including information about minors;
• enter only necessary information and protect your device against unauthorised access;
• check schedules and notifications and keep appropriate backups of important information; and
• not infringe third-party rights, distribute malicious code, or interfere with the App or its services.

Core information remains on your device. We cannot recover local information if it is deleted or the device is lost.

4. Free version and TutorDay Pro

The free version may limit the number of active students and groups. TutorDay Pro removes those limits and is available as a one-time Google Play purchase with no auto-renewing subscription.

Purchases, taxes, payment methods, refunds, and purchase restoration are handled by Google Play under Google's rules and applicable law. Store price and availability may vary by country and currency. These Terms do not restrict mandatory consumer rights, including refund rights where provided by law.

5. Google Drive and other external services

Optional Google Drive sync, Google Play Billing, calls, SMS, Telegram, WhatsApp, and the system Share feature are provided by relevant third parties. Their own terms and policies govern your use. We do not control the availability, content, or conduct of third-party services.

By connecting an external service or choosing to export, you instruct the App to send selected information to that service. Before transfer, make sure the destination and recipient are appropriate for that information.

6. Intellectual property

TutorDay, its software, design, name, and related materials are protected by intellectual-property laws. You may not copy, sell, rent, distribute, modify, circumvent technical restrictions, reverse engineer, or decompile the App except where expressly permitted by law or by an open-source component licence.

7. Updates, availability, and termination

We may fix errors, change or discontinue features, issue updates, or stop supporting the App. Some updates may be necessary for compatibility or security. We will seek to avoid unreasonable loss of functionality but do not promise uninterrupted availability of the App or external services.

You may stop using the App at any time by uninstalling it. We may terminate your licence for a material breach of these Terms. Provisions that by their nature should survive will remain effective after termination.

8. Disclaimers and limitation of liability

TutorDay is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of fitness for a particular purpose, error-free operation, and uninterrupted availability.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost data, or loss of use arising from the App or third-party services. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

9. Governing law

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules. Disputes are subject to the competent courts of Hong Kong, unless mandatory law in your country of residence gives you the right to use another court or governing law.

10. Changes to these Terms

We may update these Terms to reflect changes to the App or law. The current version and effective date will appear on this page. By continuing to use the App after changes take effect, you accept the updated Terms.
